Products are warranted to be free from defects in material and workmanship for a period of one year from the date of shipment. Any product that proves to be defective shall be repaired or replaced at the option of Steel & O’Brien Manufacturing Inc.
Steel & O’Brien Manufacturing Inc. makes no warranties, express or implied, other than those listed above.
Steel & O’Brien Manufacturing Inc. shall not be liable for any consequential, indirect, incidental, or contingent damages.
Sanitube LLC (herein called Sanitube) warrants the products described herein to be free from defects in material and workmanship for a period of ninety (90) days from date of shipment by Sanitube under normal use and service. Sanitube’s sole obligation under this warranty is limited to replacing, as hereinafter provided, any stock (not special order or fabricated) product found to Sanitube’s satisfaction to be defective upon examination by Sanitube, provided that such product shall be returned for inspection to Sanitube within thirty (30) days after discovery of the defect. The replacement of defective products will be made without charge for parts. This warranty shall not apply to: (a) any product that has been subject to abuse, negligence, accident, or misapplication; (b) any product altered or repaired by a party not exclusively authorized by Sanitube; and (c) normal maintenance services or the replacement of service items (such as gaskets and seats) made in connection with such services. To the extent permitted by State and Federal law, this limited warranty shall extend only to the buyer and any other person reasonably expected to use or consume the warranted goods. Sanitube disclaims any and all liability for injury to persons or property, or other damages of any nature, including special, indirect, consequential, compensatory, and punitive damages, directly or indirectly resulting from the performance operation, or the failure to operate, of any equipment or process. No action may be brought against Sanitube for an alleged breach of warranty unless such action is instituted within ninety (90) days from the date the cause of action accrues. This limited warranty shall be construed and enforced to the fullest extent allowable by applicable State and Federal law.
OTHER THAN THE OBLIGATION OF SANITUBE SET FORTH HEREIN, SANITUBE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ANY OTHER OBLIGATION OR LIABILITY. THE FOREGOING CONSTITUTES SANITUBE’S SOLE OBLIGATION WITH RESPECT TO DAMAGES, WHETHER DIRECT, INCIDENTAL OR CONSEQUENTIAL, RESULTING FROM THE USE OR PERFORMANCE OF THE PRODUCT.
All returned merchandise must have a Sanitary Solutions, Inc. RGA (Return Goods Authorization) number. RGA numbers are assigned only by the Sanitary Solutions, Inc. sales team and product returned must correspond with products authorized. Returns must be made within (30) days of receipt of the return goods authorization (RGA).
Unauthorized returns will not be accepted by Sanitary Solutions, Inc., receiving department and returned freight collect. A 20% restocking charge (20% of the net invoice price) will be charged for saleable merchandise in new condition returned in original packaging. If merchandise is not in new condition, a reconditioning charge will be deducted from the credit. Merchandise not of Sanitary Solutions, Inc., manufacture or custom fabrications are not eligible for return.
All items manufactured by Advance Fittings Corp. are warranted to be free from manufacturing defects in materials and workmanship for one year from date of shipment. The warranty is valid only if the product has been installed per current ASME BPE Standards, when applicable, or recognized piping practice procedures and has not been subjected to service beyond the capabilities of the item.
Maximum liability for claims, losses, or damages shall be, at the option of Advanced Fittings Corp, either the repair or replacement of the defective items without charge. In no event shall Advance Fittings Corp. be liable for consequential, indirect, incidental or contingent damages.
Advance Fittings Corp. makes no other warranties, expressed or implied, of merchantability or fitness.
Sani-Matic’s obligation (and Purchaser’s right or recourse) under the foregoing warranty and under any other contract warranty or performance guarantee, if any, shall be limited to the repair or replacement (at Sani-Matic’s option) of the Equipment in question or parts thereof, and does not include shipping costs or the cost of field labor for removing or reinstalling such parts or Equipment. No such repair or replacement shall extend the original warranty period. Such repair or replacement (whichever Sani-Matic determines, in its discretion, to provide) shall be Sani-Matic’s sole obligation and Purchaser’s exclusive remedy for any deficiency in goods furnished hereunder, and shall be conditioned upon Purchaser’s return of such goods to Sani-Matic, F.O.B. Sani-Matic’s loading dock or, for international sales, DDP Sani-Matic’s loading dock, as that term is defined in Incoterms 2010 (as though Purchaser were the “seller” and Sani-Matic the “buyer”).
THE WARRANTY IN SUBDIVISION A ABOVE IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES (WHETHER WRITTEN, ORAL OR IMPLIED) AND SANI-MATIC EXPRESSLY DISCLAIMS AND EXCLUDES THE IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR ANY PARTICULAR PURPOSE AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. ADDITIONALLY, NO WARRANTY IS MADE REGARDING THE EFFICACY OF ANY CLEANING AGENT OR OTHER CHEMICAL USED IN CONNECTION WITH THE EQUIPMENT. Sani-Matic’s liability shall not be extended because of any advice or assistance given by Sani-Matic in connection with the design, sale, installation, use, performance, repair or replacement of any product or service not sold by Sani-Matic.
If any performance guarantees on equipment are expressly given, such guarantees will be deemed to have been fully satisfied when, during installation and/or commissioning, Sani-Matic causes the equipment to have the capacity to achieve such performance, or is excused from so doing by any act or omission of Purchaser or other cause beyond Sani-Matic’s control.
If the Equipment is being sold to Purchaser for resale or lease to others, Purchaser shall make the foregoing warranty an integral part of all such resales or leases and shall not in any way vary the terms or conditions of such warranty. In the event of such resale or lease Purchaser shall indemnify and save Sani-Matic harmless from and against all claims, suits, liability and expenses (including attorney’s fees) based upon any actual or alleged act or omission of Purchaser and/or those acting on its behalf, including without limitation improper installation and/or unauthorized alteration of the Equipment and unauthorized variation from Sani-Matic’s standard warranty
